Constant Digital Holdings LLC (“Ham.Live”, “we”, “us” or “our”) values your privacy. In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose information that we obtain about visitors to our website at Ham.Live (the “Site”) and the services available through our Site to host amateur ham radio nets (collectively, the “Services”), and how we use and disclose that information.

By visiting the Site, or using any of our Services, you agree that your personal information will be handled as described in this Policy. Your use of our Site or Services, and any dispute over privacy, is subject to this Policy and our Terms of Use, including its applicable limitations on damages and provisions for the resolution of disputes.

If you are a California resident or a resident of the European Union, additional provisions may apply to you as set below.

The Information We Collect About You
We collect information about you directly from you and from third parties, as well as automatically through your use of our Site or Services.
Information We Collect Directly From You. You may browse certain areas of the Site without registering with us or providing us personal information. If you register for our Services, then you must provide your name, amateur radio callsign, location, and email address. In addition, we collect your personal information in the following other ways:

Google Authentication: Upon successful authentication, Ham.Live receives name, email address, profile photo link and a unique Google ID.

Microsoft mapping service: With your permission, location can be auto-populated. If you provide consent, when prompted, your coordinates will be sent to Microsoft Azure’s reverse mapping service where it will resolve to a human-readable location. Ham.Live stores the resulting human-readable location (which you can edit as you see fit), not the coordinates.

Ham.Live Net Communications: The Services provide an online interface where users can join and follow Ham Radio nets. We collect and allow users to see who is checked in / checked out, see each other's callsign/name/location and participate in interactive chats. In addition, if you are providing personal information for third parties in connection with using our Services, you are responsible for ensuring that you have all required permissions and consents to provide such personal information to us for use in connection with the Services and that our use of such personal information to provide the Services does not violate any applicable law, rule, regulation or order.

Information We Collect Automatically. We may automatically collect the following information (“Usage Data”) about your use of our Site or Services through cookies and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Site or use our Services; and the referring URL, or the webpage that led you to our Site. We may combine this information with other information that we have collected about you, including, where applicable, your user name, name, and other personal information Please see the section “Our Use of Cookies and Other Tracking Mechanisms” below for more information.
How We Use Your Information

We use your information, including personal information, for the following purposes:

We use your information to communicate with you about your use of our Site and Services, to respond to your inquiries, to fulfill your orders, and for other customer service purposes.

We use your information to tailor the content and information that we may send or display to you, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using the Site and Services.

We use your information to tailor the content and information we send to others. If you attend a net either over the air and/or online, your information (name, location, callsign, avatar) will be shown to other net attendees on Ham.Live.

We use your information to ensure our Site and Services are working as intended, to better understand how users access and use our Site and Services, both on an aggregated and individualized basis, to make improvements to our services, to develop new Services, and for other research and analytical purposes.

We use your information for marketing and promotional purposes. For example, we may use your information, such as your email address, to send you news and newsletters, special offers, and promotions, to conduct contests and sweepstakes, or to otherwise contact you about products or information we think may interest you. We also may use the information that we learn about you to assist us in sending your targeted advertising on Ham.Live and on third party websites based on your interests and preferences.

Compliance

We may use your information to detect, investigate, and prevent activities on our Site and Services that may violate our terms of use, could be fraudulent, violate copyright, or other rules or that may be otherwise illegal, to comply with legal requirements, to defend or exercise legal claims, to respond to law enforcement or governmental investigations or requests, and to protect our rights and the rights and safety of our users and others.

Our Use of Cookies and Other Tracking Mechanisms

We and our service providers use cookies and other tracking mechanisms to track information about your use of our Site and Services. We may combine this information with other personal information we collect from you (and our third party service providers may do so on our behalf).

Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies), but such disabling will impair use of the Site and Services.

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Site and Services. There are two types of cookies: session and persistent cookies.

We use automated devices and applications, such as Google Analytics, to evaluate usage of our Site and our Services. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. We do not share your personal information with these third parties.

Third-Party Links

Our Site and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third party websites. We are not responsible for the information practices of such third party websites. (for example support.ham.live - owned and operated by Zoho Desk)

Security of My Personal Information

We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security.

You should take steps to protect against unauthorized access to your computer and email by, among other things, signing off after using a shared computer. We are not responsible for any activity on your account via unauthorized access due to a lack of end-user security best practices.

What Rights Do I Have Regarding My Personal Information

You may request access, a copy, modification or deletion of personal information that you have submitted to us by contacting us at support@ham.live. We will use reasonable efforts to accommodate such requests to the extent required by law, provided that we may be required to retain personal information to comply with legal obligations, accounting requirements, or for other business purposes. We may request additional information to verify the identity of the requesting party before responding to a request. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site for a period of time.

What Choices Do I Have Regarding Use of My Personal Information for Promotional or Informational email and Targeted Advertising?
Location of Information
Our Site and Services are offered from the United States. We store any information we collect in the United States. If you access the Services or Site from outside the United States, you agree to the transfer of your personal information to the United States, which may have less protections for your personal information than your jurisdiction of residence.
Individuals Under 18 Years of Age
Our Site and Services are not designed for minors. If we discover that someone under 18 has provided us with personal information, we will delete such information from our systems.

CALIFORNIA PRIVACY NOTICE

This California Privacy Notice supplements the Ham.Live Privacy Policy (“Policy”) and contains the disclosures required under the California Consumer Privacy Act (“CCPA”). For individuals who are California residents, the CCPA requires certain disclosures about the categories of personal information we collect and how we use it, the categories of sources from whom we collect personal information, and the third parties with whom we share it. You have also the right to exercise certain rights regarding your personal information.

Please note that for California residents, the term personal information means information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular consumer or household as defined in the CCPA. All other capitalized terms have the same meanings as given them in the Policy.

Data Subject Requests
If you are a California resident who has provided personal information to Constant Digital Holdings LLC (via Ham.Live), or a California resident that reasonably believes that Constant Digital Holdings LLC collected or stored their personal information, you have the right to request Constant Digital Holdings LLC to:
  1. Disclose the categories of personal information we collected about you (unless any record of your data was deleted as the result of account deletion) (“Request to Know”).
  2. Disclose the specific pieces of personal information that we have collected on you (unless any record of your data was deleted as the result of account deletion) (“Request to Know”);
  3. Delete personal information we have collected on you (“Request to Delete”);

Note: Constant Digital Holdings does not sell your personal information as that term is defined by the CCPA or Nevada law.

You can only make two Requests to Know in a 12-month period.

Methods For Submitting Request
You may submit Requests to Know by sending an email to support@ham.live.
Verification of Requests
We will need to verify your identity to respond to Requests to Delete and Requests to Know. This may include us requesting successful authentication to Ham.Live.
Time for Response

Please note that once you have submitted a Request to Know or Request to Delete, we will send you a receipt, acknowledging your request, within 10 business days. If, for some reason, you do not receive such a receipt within 10 days of your submitted request, please send us an email to support@ham.live as an error may have occurred.

We will respond to Requests to Know and Requests to Delete within 45 calendar days after they are received. If we cannot verify you within the 45-day time period, we may deny the request. If necessary, we may take up to an additional 45 calendar days to respond to the consumer’s request, for a maximum total of 90 calendar days from the day the request is received, provided that we will provides you with notice and an explanation of the reason that we will take more than 45 days to respond to the request.

In the case of a Request to Delete, we may use a two-step process for online requests to delete where you must first, submit the Request to Delete and then second, separately confirm that you want your personal information deleted.

Authorized Agent
As a California resident, you have the right to designate an agent to exercise these rights on your behalf. We may require proof that you have designated the authorized agent to act on your behalf and to verify your identity directly with us. Please contact us at support@ham.live for more information if you wish to submit a request through an authorized agent.
Non-Discrimination
We hereby inform you that if you exercise any of your rights under the CCPA we may not deny you goods or services for that reason, or subject you to different prices than those paid by other consumers, unless provided otherwise under the CCPA, Federal, or State law.

This serves as notice of the categories of personal information that we collect or have collected in the past 12 months through the Site and Services, the business or commercial purposes for which such personal information was collected, the categories of third parties to whom such personal was disclosed and the categories of sources of such personal information.

We collect personal information from users and third-party service providers, including analytics providers. We do not sell personal information, but disclose personal information to third-party service providers and other users of the Services.

Data Retention
We retain personal information about you for the time necessary to accomplish the purpose for which such information was collected. Upon requesting account deletion, we will use reasonable efforts to delete the user data (described in the Notice at Collection) within 48 hours. Abandoned accounts (defined as accounts which have not been logged into for 180 days) will be flagged for deletion within 48 hours of the 180 day period. Once an account is flagged for deletion either by user request or after the aforementioned 180 day window, a user may opt to remove the deletion flag (settings | Your Privacy | Delete my Account | Undelete). If the deletion flag is not removed, the account will be permanently deleted within 48 hours of the deletion flag being set.
GDPR/UK Notice
Data Subjects of the European Union and the United Kingdom may have the following rights to the extent the UK Data Protection Act or the General Data Protection Regulation applies to their personal information:

If you believe our processing of your personal information violates data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged violation or in the case of the United Kingdom with the Information Commissioner’s Office (see. www.ico.uk).

Submitting Requests: You can submit requests by contacting us at support@ham.live. We will respond to all such requests within 30 days of our receipt of the request, unless there are extenuating circumstances, in which event we may take up to 60 days to respond. We will inform you if we expect our response to take longer than 30 days. Please note, however, that certain personal information may be exempt from such rights pursuant to applicable data protection laws. In addition, we will not respond to any request unless we are able to appropriately verify the requester’s identity. We may charge you a reasonable fee for subsequent copies of personal information that you request. In addition, if we consider that a request is manifestly unfounded or excessive, we may either request a reasonable fee to deal with the request or refuse to deal with the request.
